If you are buying agency services in Australia, three things matter more than any vendor list: where the capability actually sits, what the advertising, spam and privacy rules require of your campaigns, and whether the agency can evidence the claims it makes. How large the Australian market is
IAB Australia''s Internet Advertising Revenue Report, prepared by PwC Australia, put total Australian internet advertising spend at $16.4 billion for calendar 2024, an 11.1% increase year on year.

The broader agency-booked market has been flatter than the digital total. Guideline SMI reported that total Australian agency ad bookings finished 2025 down about 2% on the prior year, after a first half lifted by the federal election and a softer second half.

What this means for a buyer: digital demand is still growing while total agency bookings are not, so agencies are competing harder for retained work. That is good for negotiation and bad for stability — ask who stays on your account if the agency wins a much larger client next quarter.
Where the capability sits geographically
Sydney and Melbourne hold the deepest concentration of brand, media and performance capability, with substantial independent studios in Brisbane, Perth and Adelaide, and specialists working nationally from regional bases. Distance is normal here: most Australian agencies run remote or hybrid client relationships across time zones as a matter of course.
City is not a quality signal in either direction. It matters for two practical reasons only: how often you get senior people in the room, and whether the agency has actually run campaigns in the state or category you are targeting.
Domestic versus cross-border work
Many Australian agencies sell into New Zealand, Southeast Asia, the UK and the US, and many overseas brands buy Australian creative and retail-ready packaging design. If you are buying across a border, agree the contract currency, who carries exchange-rate risk, whether GST applies to the engagement, where the work is performed, and how personal data moves between jurisdictions. Those answers belong in the contract, not the pitch.

The AANA Codes and Ad Standards
Advertising and marketing communications in Australia are self-regulated under the AANA Code of Ethics and the related AANA Codes, which are platform and technology neutral and apply across all channels. Complaints are handled by Ad Standards.

The Australian Consumer Law
The ACCC enforces the Australian Consumer Law, under which businesses must not make misleading or deceptive claims and must be able to substantiate the claims they make.

Ask candidate agencies who holds the substantiation file for performance claims, testimonials and comparative advertising, and what happens when a claim cannot be evidenced.
Spam, telemarketing and the Do Not Call Register
Email and SMS marketing sit under the Spam Act 2003 and telemarketing under the Do Not Call Register regime, both regulated by ACMA. ACMA has published a Statement of Expectations on how businesses should obtain and record consumer consent for direct marketing.

Privacy
Personal information handling is governed by the Privacy Act 1988 and the Australian Privacy Principles. The Privacy and Other Legislation Amendment Act 2024 received Royal Assent on 10 December 2024 and expanded the Information Commissioner''s powers, with further reform tranches flagged.

Ask any agency proposing email, SMS or paid social how consent is recorded, how consent expiry is handled, who is controller and who is processor of your customer data, and who owns the list and the ad accounts.
What to ask before you shortlist
- Which named people will actually do the work, and what percentage of their week is yours?
- Show two engagements similar to ours in scope and budget, with the outcome and a client contact who can confirm it.
- What is the minimum engagement, and what does it buy in the first 90 days?
- Which parts of the work are subcontracted, and to whom?
- Who holds substantiation for the claims in our advertising?
- What happens to ad accounts, creative files, pixels and data if we leave?
What to treat as weak evidence
- Awards with no named jury, year or category.
- Client logos with no described engagement.
- Directory rankings you cannot trace to a published method.
- Case studies with percentages but no baseline, timeframe or attribution method.
- Guaranteed positions, rankings or lead volumes.
